U.S. ENDS wholesale compliance verification
What a distributor, wholesaler or sourcing manager should verify for an exact product before asking for a U.S.-destination quote.
Do not verify at brand level. Match the exact product name, manufacturer, model or SKU and FDA record; then confirm destination-specific rules, documents and your role in the transaction with qualified counsel or the relevant authorities.
Before requesting a quote
1. Identify the exact product
Record the manufacturer, brand, model, product format, nicotine type and strength, package configuration and any SKU or submission tracking number. A similar brand name, flavor or device appearance is not an exact match.
2. Check FDA's current product record
Search the exact identity in FDA's Searchable Tobacco Products Database. FDA describes the database as a list of products that may be legally marketed and links available order letters and decision documents. For ENDS, review the corresponding record and documents rather than relying on a screenshot or a supplier statement alone.
3. Distinguish an order from an application
FDA states that new tobacco products requiring authorization may not be legally marketed without a written marketing order. FDA also states that a pending application does not create a safe harbor to sell the product. Review the agency's Tobacco Products Marketing Orders and database guidance.
4. Verify the destination and buyer role
Federal product status is only one part of a procurement review. State and local restrictions, licensing, tax, age-verification, labeling, sales-channel and delivery rules may also apply. Requirements can differ for an importer, distributor, wholesaler and retailer. Confirm the current requirements with qualified counsel and the relevant federal, state and local authorities.
5. Request an auditable document set
- Exact manufacturer and product identity matching the goods and packaging
- Applicable FDA record, order letter or other claimed marketing authority
- Current package, label and nicotine specifications for the exact SKU
- Importer, consignee and distribution-party information for the proposed transaction
- Any destination-specific licenses or records your counsel says are required
A KKFOG catalogue page or quote request does not establish U.S. authorization, inventory, import eligibility or legal suitability. Each exact SKU and transaction must be verified independently.

Frequently asked questions
Does an FDA application mean the product may be sold?
No. FDA states that a pending application does not create a safe harbor for a product that requires authorization.
Can authorization be inferred for a whole brand?
No. Match the exact product identity and FDA record or order. Do not transfer the status of one SKU to a different SKU, flavor, strength or device.
Does this page confirm destination eligibility?
No. It is an educational procurement checklist, not legal advice. Verify current federal, state and local requirements with counsel or the relevant authorities.
